Terms and Conditions for Accommodation

1. Scope of application

Accommodation contracts and related contracts concluded by Grand Stay Yufuin with guests shall be in accordance with the provisions of these terms and conditions, and matters not stipulated in these terms and conditions shall be in accordance with laws or generally established customs.

When this facility complies with a special contract to the extent that it does not violate laws and customs, the special contract shall take precedence regardless of previous regulations.

2 Application for an Accommodation Contract

A person who wishes to apply for an accommodation contract with this facility will be asked to submit the following details to the facility.

  1. Guest and pet information
  2. Date of stay and estimated time of arrival
  3. Accommodation fees (as a general rule, according to the basic accommodation fees in the attached table)
  4. Other matters deemed necessary by this facility

If a guest requests an intermittent stay beyond the previous date of stay during their stay, the facility will process it as if they had applied for a new accommodation contract at the time the request was made.

3. Conclusion of Accommodation Contracts, etc.

  1. An accommodation contract shall be concluded when the facility accepts the application set forth in the preceding article, and the facility's accommodation agreement will be applied as the details of the contract at the time of stay. Also, when applying for accommodation from the internet, in addition to this facility's accommodation agreement, the terms of use of each reservation site also apply. However, this does not apply when it is proven that the facility did not accept it.
  2. When a contract is established in accordance with previous regulations, the application fee determined by the facility, up to the basic accommodation fee for the period of stay (3 days if it exceeds 3 days), will be paid by the date specified by the facility.
  3. The application is first applied to the accommodation fee that the guest should finally pay, and when there is a situation where the provisions of Article 6 and Article 18 are applied, it is applied in the order of compensation after the penalty, and if there is any balance, it will be refunded when the fee pursuant to the provisions of Section 12 is paid.
  4. If the application fee set forth in paragraph 2 is not paid by the date specified by the facility in accordance with the provisions of the same paragraph, the accommodation contract shall lose its effect. However, when specifying the due date for payment of the application fee, this is limited to when the facility informs the guest to that effect.

4. Special agreement that does not require payment of an application fee

  1. Notwithstanding the provisions of paragraph 2 of the preceding article, this facility may respond to a special agreement that does not require payment of the application fee set forth in the same paragraph after the contract is established.
  2. When accepting an application for an accommodation contract, if the facility does not request payment of the application fee as set forth in paragraph 2 of the preceding article or if the due date for the payment of the application fee is not specified, it will be treated as in accordance with the special agreement set forth in the preceding paragraph.

5 Refusal to conclude an accommodation contract

The facility may not accept the conclusion of an accommodation contract in the following cases. However, this section does not mean that this facility may refuse accommodation in cases other than those listed in Section 5 of the Ryokan Business Act.

  1. When an application for lodging does not comply with these terms and conditions.
  2. When there is no room available due to full occupancy (occupancy).
  3. When it is recognized that there is a risk that a person intending to stay will act contrary to the provisions of laws and regulations or public order or good manners with respect to lodging.
  4. When it is clearly recognized that the person intending to stay is infected with an infectious disease.
  5. When a special burden is required for lodging.
  6. When it is impossible to accommodate guests due to natural disasters, facility failure, or other unavoidable reasons.
  7. Disaster victims and disaster recovery due to the occurrence of disasters or other emergencies
    When there are reasons similar to the previous issue, such as when it is actually planned that guest rooms should be provided on a priority basis due to the former person in charge, etc.
  1. When there is a risk that a person intending to stay will act in a way that will cause significant inconvenience to other guests or employees.
  2. When there is a risk that the guest room will be used beyond its capacity.
  3. When there is a risk that a person intending to stay will cause significant inconvenience to other guests, such as bringing in explosives or weapons.
  4. When the person intending to stay is a gang or a member of a gang or a member of a gang under the “Act on the Prevention of Unfair Acts by Gangster Members, etc.”
  5. When only minors without parental permission stay.
  6. When an application for lodging is made for the purpose of transferring the right to stay to another person.
  7. When a person intending to stay does not make the next statement, or when false information is included in the statement.
  8. Other cases where it is possible to refuse lodging as stipulated by various laws or prefectural ordinances, etc.

6. Contract customer's right to cancel the contract

  1. Guests can cancel the accommodation contract by contacting the hotel.
  2. The hotel cancels all or part of the accommodation contract due to reasons attributable to the guest (this is the case where the facility specifies the payment date of the application fee and requests payment in accordance with the provisions of Article 3 (2), excluding when the guest cancels the accommodation contract prior to that payment.) You will be charged a penalty as listed in Attached Table 2. However, if the facility complies with the special contract described in Article 4 (1), it is limited to when the facility informs the guest about the obligation to pay the penalty when the guest cancels the accommodation contract in order to comply with that special agreement.
  3. If the guest does not arrive even at 6:00 p.m. on the day of stay (when the scheduled arrival time is specified in advance, the time 1 hour has passed since that time) without contacting the guest, the hotel may process the accommodation contract as having been canceled by the guest.

7. Explanation of Cancellation of Accommodation

For lodging, if the facility cancels the accommodation contract based on the preceding article, it is possible to ask the hotel to explain the reason.

  1. When it falls under Article 5 (3) to (17), or when it is found that it is applicable.
  2. When you do not register as described in the next section, or when false information is included in the registration.
  3. Article 12. When payment is not made.
    1. Notifications of cancellation based on the preceding paragraph shall be made by telephone, email, or writing to the customer's contact information requested based on section 2, and if the notification does not reach the contact address requested based on section 2, in addition to applying the provisions of section 3 (3), it is assumed that it has arrived as if it has arrived when the period to which it should normally be reached has passed.
    2. If the facility cancels the accommodation contract based on the provisions of the preceding two paragraphs, the accommodation fee will not be refunded, except in the cases of Article 5 (4) and (7).

8. Registration of Accommodation

On the day of your stay, you will be asked to register the following information at the check-in counter at this facility.

  1. The name, age, gender, address, and occupation of all guests and guests
  2. For foreigners who do not have an address within Japan, nationality, passport number, place of entry, and date of entry
  3. Departure date and scheduled departure time
  4. Information about pets
  5. Other matters deemed necessary by this facility

9. Hours of use of guest rooms

  1. The time that guests can use the hotel's guest rooms is from the check-in time to the check-out time determined by the hotel. However, when staying continuously, you can use it throughout the day except for the day of arrival and departure.
  2. Notwithstanding the provisions of the preceding paragraph, this facility may accept the use of guest rooms other than the hours specified in the same paragraph. In this case, if the check-in time on the scheduled departure date is exceeded, an additional fee equivalent to one night's accommodation fee shall be charged, and the same applies to use from before the check-out time on the day of arrival.
  3. Even within the time the customer can use the guest room based on the preceding two paragraphs, the facility shall be able to enter the guest room and take necessary measures when necessary for safety and hygiene management or other operational management of the facility.

10. Comply with usage rules

  1. Guests are required to follow the usage rules set by this facility and posted within the facility.

11. Business Hours

  2. The hours set forth in the preceding paragraph may be temporarily changed if necessary and unavoidable. In that case, we will let you know with an appropriate method.

12 Payment of Fees

The breakdown of accommodation fees, etc. to be paid by guests is as listed in Attached Table 1.

To pay the accommodation fees, etc. described in the preceding paragraph, you must use a credit card (web payment) or payment to the designated account at this facility at the time of application.

The facility provides guest rooms, and an accommodation fee will be charged even if the guest does not voluntarily stay after they have been able to use them.

Additional usage charges incurred during your stay at this facility will be processed by credit card payment.

13. Responsibilities of this facility

  1. The responsibility for lodging at this facility begins when the guest checks in at Grand Stay Yufuin and ends when the guest checks out to leave.
  2. The facility will pay compensation for damages when fulfilling an accommodation contract and contracts related thereto, or when damage is caused to the guest due to failure to perform them. However, this does not apply when it is due to reasons not attributable to this facility.
  3. This facility is covered by liability insurance to deal with unexpected fires, etc.

14 Handling when contracted guest rooms cannot be provided

  1. When the facility is unable to provide the contracted guest room, it shall obtain the consent of the guest and arrange for other accommodations under the same conditions as much as possible.
  2. Notwithstanding the provisions of the preceding paragraph, when the facility is unable to transfer to another lodging facility, a compensation fee equivalent to a penalty fee will be paid to the guest, and the compensation fee will be applied to the damage compensation amount. However, compensation will not be paid when there are no reasons attributable to the facility for not being able to provide guest rooms.

15 Handling of Deposited Articles, etc.

  1. When damage such as loss, damage, etc. occurs with respect to goods, cash, or valuables that the guest has left at the front desk, the facility will compensate for the damage, except when it is force majeure. However, with regard to cash and valuables, this is when the facility asks for clarification of the type and value, and if the guest fails to do so, the facility will compensate for the damage up to 10 million yen.
  2. When damage such as loss, damage, etc. occurs due to the intention or negligence of the facility to goods or cash brought into the hotel by the guest, or valuables, the facility will compensate for the damage. However, for items that have not been specified in advance by the guest, the facility will indemnify the damage up to 10 million yen, except when the facility has intentional or gross negligence.

16. Storage of luggage or personal belongings at the hotel

  1. If the customer's baggage arrives at the hotel prior to their stay, they will only store it if they contact the facility prior to arrival and agree to this.
  2. After the customer has checked out, if the customer's luggage or portable items are left behind at the facility, as a general rule, the facility will store it for 7 days, including the date of discovery, and if the customer does not request a return during that time, it will be delivered to the nearest police station. However, valuables shall be immediately delivered to the nearest police station.
    Also, if there is no contact during the check-out day, food and drink, magazines, and other items similar to waste will be voluntarily disposed of at this facility.
  1. In order to properly dispose of misplaced baggage or portable items according to the nature of the contents, this facility can voluntarily inspect the contents and return them to the lost person or process them in accordance with the preceding paragraph as necessary, and guests cannot state the significance of this.

17. Parking Liability

When guests use the hotel's parking lot, the facility rents out a place and is not even responsible for managing the vehicle. However, when managing a parking lot, if damage is caused due to the intention or negligence of this facility, we will be liable for compensation.

18. Disclaimers relating to internet services

It is assumed that this is done at the customer's own risk.

This facility is not responsible for any damage caused by a system failure or other reason when the service is interrupted while using computer communication, and the user suffers any damage as a result.

Also, if damage is caused to this facility or a third party due to an act that the facility determines is inappropriate for using computer communication, the damage will be compensated.

19. Guest Responsibilities

If the hotel suffers damage due to the guest's intention or negligence, the guest concerned shall pay compensation to the facility for the damage.

Amendments to Treaty Clause 20

  1. These terms and conditions may be revised from time to time as necessary. If these terms and conditions are revised, the facility shall post the details and effective date of the revised agreement on the facility's website.
